Acceptance of Terms
By downloading, installing, or using the useby mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Maldomedia LLC ("we," "us," or "our"), the company that operates useby.
Description of Service
useby is a product lifecycle management tool that helps you track expiration dates, monitor product recalls, manage household inventory, and reduce waste. Our services include:
- Barcode scanning and product identification
- Expiration date tracking and shelf-life estimates
- Product recall notifications sourced from government agencies
- Shopping list and inventory management
- Push notifications, in-app alerts, and email summaries
Important Disclaimer
useby is an informational tool only. We aggregate data from public sources including the U.S. Food and Drug Administration (FDA), U.S. Consumer Product Safety Commission (CPSC), U.S. Department of Agriculture (USDA), and Open Food Facts. We cannot guarantee the completeness, accuracy, or timeliness of this information. Always verify recall information directly with manufacturers and official government sources. Shelf-life estimates are general guidelines and actual shelf life varies based on storage conditions, handling, and product-specific factors.
Eligibility
You must be at least 13 years of age to use useby. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent that you have the legal capacity to enter into this agreement.
User Account
To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
User Responsibilities
When using useby, you agree to:
- Use the App in compliance with all applicable laws and regulations
- Provide accurate information when using App features
- Verify all recall information independently before taking action
- Not rely solely on the App for product safety decisions
- Check your own products directly, read labels, and follow manufacturer instructions
- Not use the App for any illegal or unauthorized purpose
- Not attempt to access, modify, or damage our systems or infrastructure
Notifications and Alerts
useby may send push notifications, in-app alerts, and email communications related to expiring products, recall matches, and other informational updates. You can manage your notification preferences within the App settings at any time.
Notification Delivery
We do not guarantee that notifications, alerts, or reminders will be delivered or received. Notifications are transmitted over networks and systems beyond our control. Multiple factors may affect delivery, including but not limited to: network availability, device settings, operating system restrictions, battery optimization, app permissions, push notification service availability, and email delivery conditions. The absence of a notification does not indicate the absence of a safety concern. You should not rely solely on useby notifications for product safety decisions.
Shelf-Life Estimates
useby provides shelf-life estimates based on general food safety guidelines, product category data, and publicly available storage recommendations. These estimates are informational guidelines only. Actual product shelf life varies depending on storage conditions, handling, manufacturing processes, packaging, and other factors specific to individual products. Always use your own judgment when evaluating whether a product is safe to consume or use.
Recall Information
Recall data displayed in useby is sourced from government agencies including:
- U.S. Food and Drug Administration (FDA)
- U.S. Consumer Product Safety Commission (CPSC)
- U.S. Department of Agriculture, Food Safety and Inspection Service (USDA FSIS)
We synchronize this data on a regular schedule but cannot guarantee real-time accuracy. There may be delays between when a recall is issued by an agency and when it appears in useby. We are not responsible for the accuracy, completeness, or timeliness of third-party recall data. The App is designed primarily for users in the United States, and recall information may not be applicable in other countries.
Product Data
Product information obtained through barcode scanning is sourced from Open Food Facts and other publicly available databases. We do not guarantee the accuracy of product names, images, ingredients, allergen information, or nutritional data. Always refer to the physical product label for authoritative product information.
Intellectual Property
The App and its content, including but not limited to software, design, graphics, logos, icons, and text, are owned by Maldomedia LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reverse engineer the App or any portion of it. The useby name, logo, and related marks are trademarks of Maldomedia LLC. Recall data is sourced from public government databases and remains the property of the respective agencies.
Privacy and Data Use
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. Your personal data is never sold, rented, or shared with third parties for marketing purposes.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, error-free, or free of harmful components
- All recall information will be complete, current, or accurate
- Shelf-life estimates will accurately reflect the condition of any specific product
- Notifications will be delivered on time or at all
- The App will meet your specific requirements
- Any defects will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MALDOMEDIA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or use
- Personal injury, illness, or property damage
- Damages resulting from reliance on recall information, shelf-life estimates, or any other information provided by the App
- Damages resulting from failure to receive notifications or alerts
- Damages related to consumption or use of products tracked in the App
- Any damages arising from your use or inability to use the App
In jurisdictions where liability cannot be fully excluded, our total aggregate liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Maldomedia LLC, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to your use of the App, your violation of these Terms, or your infringement of any third-party rights.
Prohibited Uses
You may not use the App to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of any party
- Transmit harmful, offensive, or inappropriate content
- Attempt to gain unauthorized access to our systems or databases
- Use automated tools, bots, or scrapers to access or extract data from the App
- Interfere with the App's operation or other users' experience
- Resell, redistribute, or commercially exploit the App or its data
Termination
We may suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms, misuse of the App, or if required by law. You may stop using the App at any time by deleting it from your device and requesting account deletion. Upon termination, your license to use the App immediately ceases.
Apple App Store Terms
If you download the App from the Apple App Store, you acknowledge and agree that:
- These Terms are between you and Maldomedia LLC, not Apple Inc. Apple is not responsible for the App or its content.
- The license granted is limited to a non-transferable license to use the App on Apple-branded products you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support services for the App.
- Apple is not responsible for addressing any claims relating to the App or your use of it.
- In the event of any third-party claim that the App infringes intellectual property rights, Maldomedia LLC, not Apple, is responsible for investigation and defense.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play Terms
If you download the App from Google Play, you acknowledge that Google has no obligation to provide maintenance, support, or warranty services for the App. Any claims related to the App should be directed to Maldomedia LLC, not Google.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App, on our website, or by email. Continued use of the App after changes become effective constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts located in the State of Texas.
Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Maldomedia LLC regarding the App.
